These terms and conditions – as may be amended from time
to time – apply to all our services directly or indirectly (through
distributors) made available online, by email or by telephone. By accessing,
browsing and using our website and/or by completing a reservation, you
acknowledge and agree to have read, understood and agreed to the terms and
conditions set out below.
Scope of our
service:
By making a reservation through PartyPot.ie, you enter
into a direct contractual relationship with us and hotel/service providers which
you book. From the point at which you make your reservation, we act as an Event
Facilitator, sourcing all required services as requested by you, the client. As
an intermediary between you and the hotel/service provider, we transmit the
details of your reservation to the relevant hotel/services, collect all
deposits and pre-payments in order to submit to the relevant hotel/service
provider, sending you a confirmation email for and on behalf of the
hotel/service provider.
When rendering our services, the information that we
disclose is based on the information provided to us by the hotels/service
providers. As such, the hotels/service providers confirm all information which
is displayed on our website before it becomes live and available for booking. Although
we will use reasonable skill and care in performing our services we will not
verify if, and cannot guarantee that, all information is accurate, complete or
correct, nor can we be held responsible for any errors (including manifest and
typographical errors), any interruptions (whether due to any (temporary and/or
partial) breakdown, repair, upgrade or maintenance of our website or
otherwise), inaccurate, misleading or untrue information or non-delivery of
information.
Our services are made available for personal and
non-commercial use only. Therefore, you are not allowed to re-sell, deep-link,
use, copy, monitor (e.g. spider, scrape), display, download or reproduce any
content or information, software, products or services available on our website
for any commercial or competitive activity or purpose.
Prices:
The prices on our site are highly competitive. All prices
on the PartyPot.ie website are per person sharing for your entire stay and are
displayed including VAT and all other taxes (subject to change of such taxes),
unless stated differently on our website or the confirmation email.
Privacy:
PartyPot.ie uses high ethical standards and respects your
privacy. Save for disclosures required by law in any relevant jurisdiction and
the disclosure of your name, email address and your credit card details for
completing your booking with the relevant hotel of your choice, we will not
disclose your personal information to third parties without your consent.
Free of charge:
Our service is free of charge. Unlike many other parties,
we will not charge you for our service or add any additional (reservation) fees
to the room rate. The rate you see on PartyPot.ie is the combination of all hotel/service
provider rates with no additional charges added on.
Deposit & Payments:
In order to confirm your booking PartyPot.ie requires a
deposit upon booking your package weekend. Once availability for the required
hotel/service providers has been confirmed, and the client wishes to proceed
with the reservation, an initial deposit of 25% of the total amount due is
required to secure the booking. This can be paid to PartyPot in the form of
personal cheque, money order, postal order, direct debit via bank transfer or
by furnishing credit/debit card details. (Full address & bank information available
on request).
The final balance should be paid in full no less than 6
weeks prior to the arrival date in order to complete the reservation, unless
otherwise agreed with PartyPot. If
PartyPot does not receive the full amount outstanding by the due dates
specified at the booking stage, PartyPot reserves the right at any subsequent
time before departure to cancel the booking and charge cancellation charges in
accordance with the scale set out in Cancellation Policy details below.
If the arrival date is less than 6 weeks from time of
initial reservation, 100% total amount due is required at the booking stage
unless otherwise agreed directly with PartyPot.eu.
The client confirming the booking via email or phone is
responsible for collecting and making all payments for the group. If he/she is
not in a position to do this, they must appoint someone else from the group to
collect all relevant monies and make relevant payments to PartyPot. PartyPot
can arrange to collect monies from individual group members with prior
arrangement, for a small administration fee.
All additional purchases outside the included services
advertised for the package purchased, or hotel room charges, are the
responsibility of the individual group members. Hotels who are partnered with
PartyPot.eu have their own specific requirements for the check-in stage, which
will be detailed for you in your confirmation letter. Any queries regarding
these requirements should be directed to PartyPot.eu before arrival at the
hotel in order for us to assist with your personal needs where necessary.
Cancellation:
By making a reservation through PartyPot.ie, you accept
and agree to the relevant cancellation and no-show policy below, and to any
additional terms and conditions of the hotel/service providers that may apply
to your reservation or during your stay, including for services rendered and/or
products offered by the hotel/service providers (the terms and conditions of a
hotel/service provider can be obtained directly from the hotel/service provider).
You should advise
us of cancellation by recorded letter, email or fax as soon as possible.
Cancellation of a booking is effective only when received in writing by
PartyPot from the person who originally confirmed the booking.
On booking, 25% of the total amount due is required to
secure the booking. When the booking date is more than 8 weeks prior to the
arrival date, the client is given a 7-day window in which 100% may be refunded
in the event of a cancellation. After this 7-day period, 5% of the total amount
due becomes non-refundable in the event of a cancellation.
If a booking is cancelled more than 6 weeks but less than
8 weeks prior to arrival, 50% of the total amount due applies as cancellation fee.The
balance of the total amount due is required 6 weeks prior to arrival, (where
applicable) at which point the reservation is considered confirmed, all service
providers and hotel are paid in full for the booking, and 100% cancellation fee
is imposed at this time.
In the unlikely event of PartyPot having to cancel a booking
for any reason whatsoever (missing payment deadlines deemed to be a valid
reason), a full refund of all monies paid will be made, less 5% of the total
payment due. However, where available, you may opt to transfer all monies paid
to an alternative reservation.
Disclaimer:
Subject to the limitations set out in these terms and
conditions, we shall only be liable for direct damages actually suffered, paid
or incurred by you due to an attributable shortcoming of our obligations in
respect of our services, up to an aggregate amount of the aggregate cost of
your reservation as set out in the confirmation email (whether for one event or
series of connected events).
However, neither we nor any of our affiliated companies
shall be liable for (i) any punitive, special, indirect or consequential loss
or damages, any loss of production, loss of profit, loss of revenue, loss of
contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any
inaccuracy relating to the (descriptive) information (including rates,
availability and ratings) of the hotel as made available on our website, (iii)
the services rendered or the products offered by the hotel, (iv) any (direct,
indirect, consequential or punitive) damages, losses or costs suffered,
incurred or paid by you, pursuant to, arising out of or in connection with the
use, inability to use or delay of our website, or (v) for any (personal)
injury, death, property damage, or other (direct, indirect, special, consequential
or punitive) damages, losses or costs suffered, incurred or paid by you,
whether due to (legal) acts, errors, breaches, (gross) negligence, willful
misconduct, omissions, non-performance, misrepresentations, tort or strict
liability by or (wholly or partly) attributable to the hotel (its employees,
directors, officers, agents, representatives or affiliated companies),
including any (partial) cancellation, overbooking, strike, force majeure or any
other event beyond our control.
Miscellaneous:
No contract exists until PartyPot.ie has received the
required deposit in full as outlined in Deposits & Payments above.
War, or the threat
of war, terrorist activity, political unrest, riots, civil strife, industrial
disputes, natural disaster, closure of airports or ports, road works, technical
problems with or accidents involving aircraft or other transport (including
traffic accidents/delays), fire, bad weather, force majeure (including breach of
contract by any supplier of PartyPot) can affect the planned excursion
arrangements. If any such event occurs before departure and you decline to accept
alternative arrangements PartyPot may offer, PartyPot will be entitled to
retain reasonable expenses incurred in connection with the original booking.
Should you have a complaint, please inform PartyPot.eu
via phone or email at the earliest opportunity, at which point we will endeavor
to do everything possible to help you. If the matter cannot be put right on the
spot, please follow it up with a letter to PartyPot.eu within 28 days of
returning from your excursion as PartyPot will not accept liability for claims
received outside this period.
In confirming the booking, the group leader also accepts
responsibility for the good conduct of all participants during the short break/party
weekend, and warrants that at least one responsible adult will be on active
duty at all times to ensure that all participants behave well. Furthermore, it
is the group leader's responsibility specifically to ensure that:

no participant under 18 years of age consumes
alcoholic drinks;
·
all local laws relating to the consumption of
alcohol are at all times obeyed by the participants;
·
no participant consumes alcohol to excess;
·
no participant smokes in the
accommodation/venue/centres/nightclubs or in any way causes a fire hazard;
·
participants act in a responsible fashion during
the short break/party weekend and do not behave in a way likely to cause damage
to property, or damages or causes offence to other people.
Individual properties will have specific Terms &
Conditions relating to accidental damage and/or security deposits required, and
these will be detailed in your personal confirmation letter. If you have any
queries or concerns relating to these T&C please direct them to PartyPot
prior to the arrival date in order to have your concerns addressed and resolve
any issues where required.
